Terms of Use

These Terms of Use govern the relationship between you and SĒNS (hereinafter the "Company") when you use the SĒNS application, the SĒNS smart ring, the server services (including api.sens.kz) and related features (hereinafter collectively the "Service"). The processing of personal data is described in the Privacy Policy, which forms part of these Terms.
1. Acceptance of the Terms
By using the Service — including installing the application, registering an account, pairing the ring via Bluetooth and accessing the application's features — you confirm that you:
- have read this document;
- understand its provisions;
- voluntarily agree to them.
If you do not agree to the terms, you are not permitted to use the Service.
The Service is intended for persons who have reached the age of 16 or the age of digital consent in your country of residence, whichever is higher. By registering and using the Service, you confirm that you meet this requirement.
The Service is not intended for children. The Company does not knowingly collect personal data from persons below the specified age. If you become aware that such data has been provided to the Company, please notify us at privacy@sens.kz and it will be deleted.
2. Purpose of the Service
SĒNS is a digital wellness tracker for the SĒNS smart ring. The Service helps you track wellbeing metrics, including but not limited to:
- sleep and its quality;
- heart rate (pulse);
- heart rate variability (HRV);
- stress level;
- energy and recovery;
- physical activity, steps and workouts;
- menstrual cycle;
- nutrition and water intake.
Health data comes from the SĒNS smart ring via Bluetooth, from Apple Health — only after the User's separate permission — and from the Company's servers. Access to Apple Health is used to read the workouts selected by the User and may be revoked in iOS settings at any time.
The Service may send push notifications: reports and insights, reminders, messages and events from the Community section, and ring notifications. Notifications can be turned off in iOS settings at any time; this does not affect the other features.
The Service and the SĒNS smart ring are not a medical device, are not intended for medical use and are not certified as a medical device.
3. Medical Disclaimer
3.1
The Service is not intended to diagnose, treat, monitor or prevent any disease. The metrics, charts, scores and recommendations are provided for informational and educational purposes only.
3.2
No information in the Service — including data from the ring, calculations, insights and recommendations, including those generated with the help of artificial intelligence — replaces a consultation with a qualified physician or other medical professional.
3.3
You undertake to:
- not use the Service's data as the sole basis for making medical decisions;
- consult a physician if symptoms appear, your wellbeing deteriorates or you have doubts about your health;
- in an emergency, immediately call the emergency services (ambulance) and not rely on the application or the ring.
3.4
The Company is not liable for any harm arising from the use or interpretation of the Service's data as medical recommendations, diagnoses or prescriptions.
3.5 Cycle and fertility predictions
Predictions of the menstrual cycle, ovulation and the fertile window are calculated from the data you enter and the ring's metrics (including night-time temperature) and are estimates only. They are not a method of contraception, are not intended for planning or preventing pregnancy and do not replace a consultation with a physician. Do not make decisions about pregnancy, contraception or treatment solely on the basis of these predictions.
4. Artificial Intelligence
4.1
The Service uses machine learning models and third-party artificial intelligence APIs (including but not limited to Google Gemini) to:
- analyse photos of food taken with the device's camera;
- process voice descriptions of food (microphone and speech recognition);
- generate personal insights and recommendations based on wellbeing metrics.
4.2
AI responses and recommendations:
- may contain errors, inaccuracies or incomplete information;
- are not guaranteed to be correct or up to date;
- do not constitute medical, dietary or other professional advice.
4.3
Photos and voice recordings uploaded for nutrition analysis are processed automatically. The Company stores them no longer than necessary to provide the relevant feature.
Speech-to-text conversion is performed by iOS (Apple Speech). Depending on the device and language, audio may be processed on Apple's servers in accordance with Apple's privacy policy; the Company receives only the recognised text.
4.4
Data transferred to AI providers is minimised to the extent necessary for the feature to work. The Company uses AI providers on terms under which they may not use your data to train their models or for advertising or marketing.
4.5
The Company is not liable for decisions made on the basis of AI responses, insights or recommendations.
5. Registration and Account
5.1
An account is required to use the core features of the Service. You can sign in with an email address, Sign in with Apple or Google Sign-In.
5.2
You must:
- provide accurate and up-to-date information;
- keep your credentials confidential and not give third parties access to your account;
- notify the Company immediately if you suspect unauthorised access to your account.
5.3
The Company may:
- temporarily restrict or suspend access to your account;
- block your account in the event of a breach of these terms, abuse or suspected fraud;
- apply rate limiting to protect the Service's infrastructure.
5.4 Biometric lock
You can enable an app lock with Face ID or Touch ID. Biometric data is processed only by iOS on your device and is never transferred to the Company; the Company receives only the result of the check (success or failure).
6. User Content and the Community Section
6.1
The Community section allows you to create groups, exchange text messages and images, take part in leaderboards and view friends' profiles. Content that you post in the Community (hereinafter "User Content") remains your responsibility.
6.2 Rules of conduct
It is prohibited to post or distribute content that:
- is offensive, unlawful, discriminatory or threatening;
- infringes the rights of third parties (including copyright and image rights);
- contains spam, fraud or malicious links;
- is aimed at harassing other users.
6.3 Moderation and zero tolerance
The Company applies a zero-tolerance policy to offensive, unlawful or discriminatory content and harassment. Users can report content and block other users directly in the application.
The Company reviews reports and removes infringing content, and blocks or deletes the accounts of violators, within 24 hours of receiving a substantiated report.
6.4 Privacy settings
You control which metrics and indicators your friends can see through the privacy settings in the application.
7. Subscriptions and Payments
At the time of publication of this document, the core features of the Service may be provided free of charge. If paid features or subscriptions are introduced in the future, they will be paid for through the App Store in accordance with Apple's terms. Refunds, renewals and cancellations of subscriptions are governed by Apple's rules and the App Store policy.
8. Limitation of Liability
8.1
The Service is provided "as is" and "as available".
8.2
The Company does not guarantee:
- continuous and uninterrupted operation of the Service;
- absolute accuracy of the ring's measurements and the application's calculations;
- the absence of errors, failures or delays.
8.3
The Company is not liable for:
- decisions you make on the basis of the Service's data or AI recommendations;
- errors and inaccuracies of the AI features;
- failures of the network, the Bluetooth connection or your device;
- hardware faults of the ring;
- acts or omissions of third parties and AI providers.
8.4
The Company's maximum aggregate liability to you is limited to the amount you have actually paid for the paid features of the Service in the last 12 months (if applicable), or is zero if no such payments have been made.
9. Terms for App Store Users
This chapter applies if you obtained the application through the App Store operated by Apple Inc. ("Apple").
9.1 Parties to the agreement
This document is concluded between you and the Company only, and not with Apple. The Company, not Apple, is solely responsible for the application and its content.
9.2 Scope of licence
The Company grants you a non-transferable licence to use the application on Apple-branded devices that you own or control, as permitted by the Usage Rules set out in the App Store Terms of Service (including through Family Sharing).
9.3 Maintenance, support and warranty
The Company, not Apple, is responsible for the maintenance and support of the application. Apple has no obligation whatsoever to furnish any support in respect of the application. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the application.
9.4 Claims
The Company, not Apple, is responsible for addressing any claims relating to the application, including product liability claims, claims that the application fails to conform to any applicable legal or regulatory requirement, claims arising under consumer protection law, and third-party claims that the application infringes their intellectual property rights.
9.5 Legal compliance
You represent that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. When using the application, you must comply with applicable third-party terms (for example, your wireless carrier's terms).
9.6 Apple as third-party beneficiary
Apple and its subsidiaries are third-party beneficiaries of this document and, upon your acceptance of its terms, will have the right to enforce it against you as a third-party beneficiary.
10. Changes to the Terms
The Company may update this document. We will notify you of material changes through the application, by email or by other reasonable means. The date of the last update is stated at the beginning of the document.
Continued use of the Service after the changes take effect constitutes your acceptance of the updated version. If you do not agree to the changes, stop using the Service and delete your account.
11. Termination
You may stop using the Service and delete your account at any time in the application settings.
The Company may suspend or terminate your access to the Service in the event of a breach of these terms, where required by law, or upon discontinuation of the Service (in whole or in part). The Company will endeavour to notify users in advance of any material discontinuation of the Service.
12. Governing Law
This document is governed by the laws of the Republic of Kazakhstan. Disputes arising in connection with the use of the Service shall be resolved in accordance with the applicable laws of the Republic of Kazakhstan.
